Sensitive Health and Medical Information (Protected Health Information – PHI) — when you complete dive medical exam forms, we collect detailed health data including:

• Medical history (lung/breathing, heart, neurological, psychological, back, diabetes, gastrointestinal conditions, etc.)
• Answers to the DAN Diver Medical Participant Questionnaire (including Boxes A–G)
• Information about surgeries, medications, allergies, smoking status, family history, and any other details required for medical clearance
• Any additional notes, attachments, or communications related to your dive physical

Information from Children Under 13 — we may collect personal information and health information from children under the age of 13 whose parents or legal guardians are seeking recreational dive medical clearances. This information is collected only with verifiable parental consent as required by COPPA (see Section 6).

Automatically Collected Information — IP address, browser type, device information, usage data, cookies, and similar technologies (see Section 8).

Payment Information — we do not store full credit card numbers on our website. Payments are processed securely through third-party payment processors.

• Provide and document recreational scuba and freediving medical evaluations and clearances

We retain medical records and dive clearance documentation for the period required by Texas law and professional standards (typically at least 7 years). Other website data is retained only as long as necessary for the purposes described.

6. Children's Privacy (COPPA Compliance)

• We do not knowingly collect personal information from children under 13 without verifiable parental consent.
• When a parent or legal guardian submits a dive medical questionnaire on behalf of a child under 13, we treat that submission as consent.
• Parents/guardians may review, delete, or withdraw consent for their child's information at any time by contacting us (see Section 11).
• We do not condition a child's participation in our services on the collection of more information than is reasonably necessary.

Under HIPAA (for PHI): you have rights to access, amend, and receive an accounting of disclosures of your medical records. See our Notice of Privacy Practices.

Under the Texas Data Privacy and Security Act (TDPSA) and other laws: depending on your residency and the data involved, you may have rights to access, correct, or delete your personal information; opt out of certain processing activities; and data portability (in some cases).
